This form is an important legal document. It explains the risks you are assuming by using any platform or service provided by or affiliated with IrisCare (Vertex Partners) and/or any member of IrisCare (VertexPartners). It is important that you read and understand it completely. After you have done so, please type in your name. Typing your name in the box is the same as your signature on the document. If you are under the age of 18 it will be required to have a paper format document signed by the parent or guardian of the individual.*
Introduction:
When initiating the application process with any of IrisCare's (Vertex Partner's) clients or customers, or after signing up or interacting with IrisCare's (Vertex Partner's) platforms or services, there may be a commencement of a process whereby we ask for information about and from references. Before the commencement of the reference process, the candidate hereby voluntarily waives any liability for damages that may arise during or as a result of the reference process. This waiver is applicable to IrisCare (Vertex Partners) and all encompassing employees, its partners/clients/customer/agents, and each reference involved in the process.
Authorization and Consent:
I ("the user", "the candidate", "my", "me") voluntarily consent to authorize IrisCare (Vertex Partners) ("they", "them") or any of its officers, employees, agents, partners, or clients to contact my references by asking for information from any person or entity whom they deem to be an appropriate reference based on the contact information provided by me, with an understanding that I may provide them with this information as explicit consent to contact these references. I understand and explicitly provide consent that questions may be asked about my work experience, achievements, performance, attendance, character, personality, or prior events encompassing their experience with you.
It is expressly understood that any information given is to be used for the purpose of determining interest and fit for opportunities provided by partners, agents, customers, and/or clients of IrisCare (Vertex Partners). I also hereby release IrisCare (VertexPartners) from all liability for damages or claims - including, but not limited to, defamation, interference with contract, and negligence - which may arise or result from any reference information gathered pursuant to this authorization.
Release of Liability:
I acknowledge that I have thoroughly read this document and fully understand that it is a release of liability. By signing this document, I am waiving any right I or my successors might have to bring a legal action or assert a claim against IrisCare (Vertex Partners) for your negligence or that of your employees, agents, or contractors.
By accepting the terms of this agreement, the candidate acknowledges and agrees that:
Waiver of Damages: The candidate relinquishes any right to seek damages, compensation, or legal recourse against [Recruiting Company Name], its representatives, and each reference involved in the reference check process.
Litigation Exclusion: The candidate agrees not to initiate or be party to any legal proceedings, claims, or litigation against [Recruiting Company Name], its representatives, or any reference involved in the reference check process.
Scope of Waiver: This waiver encompasses any actions, statements, or information provided during initiation of interaction with IrisCare's (Vertex Partners) platform and is effective from the initiation of the interaction until completion, which extends into perpetuity throughout the universe.
Voluntary Agreement: The candidate confirms that this waiver is entered into voluntarily, with full understanding of its implications, and is not the result of coercion or duress.
I ACKNOWLEDGE THAT I HAVE THOROUGHLY READ THIS WAIVER AND RELEASE AND FULLY UNDERSTAND THAT IT IS A RELEASE OF LIABILITY. BY SIGNING THIS DOCUMENT, I AM WAIVING ANY RIGHT I OR MY SUCCESSORS MIGHT HAVE TO BRING A LEGAL ACTION OR ASSERT A CLAIM AGAINST IrisCare (Vertex Partners) or OTHERS REFERRED TO IN THIS DOCUMENT FOR ANY NEGLIGENCE OR THAT OF OUR EMPLOYEES, AGENTS, OR CONTRACTORS.
